WHAT TYPES OF CASES ARE APPROPRIATE FOR CLASS ACTIONS?

Class actions are often used to seek injunctions and monetary damages resulting from consumer fraud (such as deceptive advertising, unfair bank or insurance charges, price-fixing conspiracies, or other unfair business practices) defective or unsafe product liability claims, securities law violations (such as fraudulent financial statements and market manipulation), and unfair employment practices (for example, illegal discrimination or failure to pay overtime). Not all lawsuits can proceed as class actions. A court must "certify" that the case may proceed as a class action, which means that the individual victims' claims are enough like one another to proceed as one class of plaintiff.
